2.5 Communications

If you contact us through the website contact form, by email, or by phone, we collect and retain the content of those communications and any information you voluntarily provide within them.

3. How We Collect Information

We use collected information for the following purposes:

Account creation and management: To create, verify, and maintain your Aurevex account in accordance with our legal obligations as an MSB.

Regulatory compliance: To fulfill obligations under the Bank Secrecy Act, USA PATRIOT Act, FinCEN regulations, and applicable state money transmission laws. This includes identity verification, transaction monitoring, suspicious activity reporting, and record retention.

Transaction processing: To execute buy and sell orders on the exchange and manage wallet balances and movements.

5. Legal Basis for Processing

Aurevex processes personal information under the following legal bases:

Legal obligation: Much of our data collection and processing is mandated by federal law. Processing for these purposes is not optional and cannot be declined without forfeiting access to Aurevex services.

Contract performance: Processing necessary to fulfill our obligations to you under the Terms of Use, including executing trades and maintaining wallet balances.

Legitimate interests: Platform security, fraud detection, and analytical activities that improve the service without overriding your privacy interests.

Consent: For optional cookie categories beyond essential functionality. You may withdraw cookie consent at any time through the cookie preference link on this site.

6. Information Sharing

Aurevex does not sell your personal information to third parties. We share information only in the following circumstances:

Service providers: We engage third-party vendors for identity verification, payment processing, cloud infrastructure, and security monitoring. These providers process data on our behalf under contractual data processing agreements and are prohibited from using your data for their own purposes.

Regulatory reporting: As required by law, we file reports with FinCEN and other regulatory bodies. This includes Currency Transaction Reports (CTRs) for transactions meeting applicable thresholds and Suspicious Activity Reports (SARs) where warranted. We are legally prohibited from disclosing to you that a SAR has been filed.

Law enforcement and legal process: We disclose information in response to lawful subpoenas, court orders, regulatory examinations, and other legally compelled requests from authorities with appropriate jurisdiction.

Business transfers: In the event of a merger, acquisition, or sale of all or substantially all assets of Ethio American LLC, personal information may be transferred to the successor entity. You will be notified of such a transfer through the email address on file.

With your consent: For any sharing not described above, we will obtain your explicit consent before proceeding.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, subject to the following specific requirements:

Records required under the Bank Secrecy Act, including transaction records and identity verification documents, are retained for a minimum of five years from the date of the transaction or account closure, whichever is later. This is a legal requirement that cannot be waived.

Account information for active accounts is retained for the duration of the account relationship and for a minimum of five years following account closure.

Website usage data collected through analytics tools is retained for a period of up to 26 months unless a shorter period is required by applicable law.

Communications received through the contact form or by email are retained for a period of three years unless the subject matter requires longer retention for legal or compliance purposes.

After applicable retention periods expire, we delete or anonymize personal information in a manner that prevents reconstruction.

8. Security Measures

Ethio American LLC implements administrative, technical, and physical security measures designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. Security measures include encryption of data in transit using TLS protocols, access controls limiting personnel access to personal information on a need-to-know basis, regular security assessments, and incident response procedures.

No electronic transmission or storage system can be guaranteed to be completely secure. While we take reasonable precautions, we cannot warrant the absolute security of any information you transmit to or through the platform. You are responsible for maintaining the security of your account credentials.

In the event of a data breach that triggers notification obligations under applicable state breach notification laws, we will notify affected individuals as required by law.

Right to Non-Discrimination: Exercising your privacy rights will not result in discriminatory treatment by Aurevex.

To exercise any of these rights, contact us at info@aurevex.org. We will respond to verifiable requests within 45 days as required by the CCPA, with the option to extend by an additional 45 days where necessary. We will require identity verification before processing privacy rights requests.
